Please read these terms and conditions prior to completing your booking documents
Information Accuracy London Baby Swim enterprises to ensure that all the information provided in our documentation or by any other mediums such as our web site, www.londonbabyswim.co.uk is accurate. However, there may be times that advertised facilities might not be continuously or completely available. Where we are aware of any changes following the receipt of your completed booking documentations and payment, we will make every effort to inform you prior to the start of your lesson.
Booking: London Baby Swim offer an online booking facility only located from a website link www.londonbabyswim.co.uk. To ensure that your booking is processed correctly:
1) When completing the online booking: make sure you put all the necessary information required and read these Term and Conditions. To be able to confirm your place you will have to make a payment of the full amount of the course. We offer an easy payment method. (If you have financial difficulty, please call us and we may be able to offer an easy payment option
2) HSBC Secure Online payment system: If you have any problem whilst processing your booking, have an email with a cancellation of your order, or have not received an automatic confirmation email, please contact London Baby Swim on 0208 400 9091
3) Ensure all relevant fields and boxes on the booking forms are completed, failure to do so will mean that we are unable to process your booking
4) During the online booking process, you will need to agree to our Terms and Conditions and our Risk Agreement. This is a condition of attending London Baby Swim Courses without exception
5) Your payment details will be held by HSBC Merchant Services and London Baby Swim do not have access to them. Repeat Term Re-booking Dates and times for the new term will be posted online 3 weeks after the current term starts. We will email and Text you when the new Term times are available to book online.To guarantee your re-booking is processed correctly, please go to our website www.londonbabyswim.co.uk and book a new place online. Please note we do not reserve or hold any places unless there are special circumstances and only by prior arrangement. It is your responsibility to book your place on time, failing to process your online booking will mean you will not have a place for the new term.
6) Completion of Agreement: Your agreement with London Baby Swim exists for the duration of the booked term. A new agreement will be created for each new term booked in line with our booking procedures and current terms and conditions.
7)London Baby Swim withdrawal from the Agreement: London Baby Swim reserves the right to withdraw from the agreement at no financial loss to London Baby Swim: if the information you have provided on the booking documentation or at any time during your London Baby Swim term is proved to be deliberately false or incorrect, or where there is a serious and or continuous infringement of national or local health and safety requirements/policy and/or the London Baby Swim Code of Conduct. London Baby Swim will not discuss or enter into legal contract with persons under the age of 18.
8) Booking Amendments: If you want to change any part of your booking after your booking confirmation and/or following the start of the term, London Baby Swim, even though we are prepared to consider any reasonable change, are unable to guarantee to make any or all such amendments. London Baby Swim reserves the right to amend any publicised or scheduled session(s) due to facility or Instructor unavailability. In that case, we will inform you at the earliest opportunity of these changes, either via post, email or text message. In the case where there are no sufficient numbers to make a session possible, we will contact you at the earliest opportunity and we will advise you of alternative times and days available.
8a) Photoshoot Booking Amendments: If you want to change your photoshoot date due to illness or last minute unavailability, we require a minimum 24 hours notice. If you give us this required notice, we will move your photoshoot to the next available photoshoot free of charge. If you do not give us the required notice or are unable to attend the second photoshoot, a fee of £35 is due to attend any subsequent date. If you wish to cancel a booked photoshoot, a minimum 14 days notice is required to receive a refund less £15 admin fee otherwise there is no option for a refund, only alternative photoshoot date.
8b) Photoshoot image rights: London Baby Swim reserves the rights to use any or all photography or video taken by us during our 'Bubblepics' photoshoots for our own publicity and promotion proposes. Such images remain the sole property of London Baby Swim/Bubblepics.
9) Administration charges for cancellations: a) On any processed online booking cancelled up to 14 days prior to the start of a term, an administration chargeof £15 will be charged. We will only accept cancellations by written notice more than 14 days in advance of your first session. Administration charges will be deducted from agreed refunds before the refund is forwarded to you. b) If you wish to cancel a processed online booking within 14 days of the start date, you may do so by contacting us in writing. In this case, no money will be refunded. Instead, you will receive a credit note for the value of the term fees paid less £20 administration fee. Please note the Credit must be used within 12 months to book another course. c) If you wish to cancel a confirmed booking once the term has already started, no refund or credit will be offered unless on medical grounds. (see below) Please note that all refunds will be made following the end of the related term.
10) Missed Lessons: All instructors and pool sessions for a Term are contracted and agreed well in advance of a Term start. Therefore,we are unable to refund any money for sessions missed because of general illness to either parent/guardian or child, holidays confirmed prior to or taken during the term or for missed sessions because of late arrival or non-attendance (voluntary withdrawals). We do however run a make-up lesson diary and if you give us notice prior to your absence, we will do our best to try to recover your missed lesson. Any makeup lessons will be at London Baby Swims discretion and depend on the circumstances of the absence. Special circumstances will have priority. Please note that we publish the exact days of the Term on the online booking. When you book your place you agree to those days and we ask you to put them in your diary to avoid missed lessons or confusion during the term.
Please note, London Baby Swim lessons are usually full. This means without your help in letting us know you are not attending a session, there is no opportunity to make-up any lessons.
11) Cancellations, Refunds and Credits: There may be circumstances out of our control, in which the pool might not be available for London Baby Swim session(s). Examples of these circumstances include (but are not limited to) damage to the pool, severe weather conditions, power failures, industrial action, and instructor sickness. Where a session(s) are cancelled due to an unforeseen circumstance, London Baby Swim will undertake every action to ensure additional session(s) within the scheduled term (including haft term) or in between terms. If you are not able to attend this alternative date, you will miss the lesson and no additional dates will be given. Where London BabySwim is unable to arrange the additional sessions(s), we will automatically credit you with the correct amount for the forthcoming term. London Baby Swim will not be able to cover the cost of any travel expenses in the event that we use an alternative venue. If you do not intend to book for a forthcoming term all requests for refunds must be forwarded in writing to:post@londonbabyswim.co.uk
12) Refunds/Credits for withdrawal on medical grounds: After a course has started, if you wish to withdraw from the agreements of your booking on a medical basis we require an email/letter cancelling your course followed by a doctors note from your GP, Consultant or Specialist within 7 days of your written cancellation, confirming the child should not swim (for at least 3 weeks), which you need to forward to post@londonbabyswim.co.uk. Where agreed, a refund for the balance of the sessions remaining from the date of the receipt of your written notification along with the doctor’s note, minus £15 administration fee, will be given to you.Please note, if you wish to cancel on medical grounds before a course has started, please see section 9) above and follow our standard cancellation policy.
Please note that all credits will be made following the end of the related term.
13) Use of the Poolside: a) One adult must enter the water with each baby or toddler. The adult in charge of the child is entirely responsible for the safety of the child both in the pool and the surrounding areas. b) All shoes must be removed before entering the poolside areas. c) Parents will need to make sure to take dirty nappies with them and not leave them in the facilities. We provide hygiene bags and baby wipes in all changing areas for this purpose. d) No solid food is to be taken into the changing rooms or onto the poolside. Drinks are acceptable in plastic containers, please no glass containers. Failing to comply may incur cancellation of your booking. e) Adults must listen to the instructor at all times and only introduce the child into the pool when instructed to do so. f) When on poolside waiting for your lesson, please try to speak quietly as too much noise will disturb the babies that are in the water. g) To enter the pool it is mandatory to wear a double nappy system for all babies and toddlers until they are toilet trained. The double nappy system is a disposable swim nappy or a re-usable swim nappy underneath a neoprene over nappy (Happy Nappy). The top nappy should fit closely enough to form a tight seal around the waist and thighs sealing over the swim nappy with no nappy visible. Failing to comply may incur the cancellation of your booking. h) Depending on location, your booking will entitle you to remain using the facility for a maximum of 30 minutes after the session due to numbers of following classes. For more information about your specific centre, please contact our main office. i) Valuables are left at owner’s risk. Please note that no jewellery (except wedding rings) are to be worn in the pool to protect the babies.
14) Spectators: We do welcome spectators at our sessions but for health and safety reasons and for the comfort of the group, this is limited depending on the Centre you are attending:
Osterley Centre: Viewer numbers are limited to 2 per baby per session. Please note we do not allow spectators inside the pool hall and they must stay in the covered viewing area available and view through the glass wall. Only the parent swimming with baby will be allowed inside the pool hall and our changing rooms. Failing to do so may incur the cancellation of your booking.
Wandsworth Centre: Viewer numbers are limited to 2 per baby per session. Please note we do not allow spectators inside the pool hall and they must stay in the viewing area available and view through the glass wall. Only the parent swimming with baby will be allowed inside the pool hall and our changing rooms. Failing to do so may incur the cancellation of your booking.
15) Photography and video recording may only be taken with the permission of your teacher and the rest of the class. You will have to complete a Photo Release for privacy and child protection prior to the class commencing.
Amendments to Terms & Conditions: London Baby Swim reserves the right to amend its booking terms and conditions and associated documentation at any time.
Statutory Rights: These terms and conditions do not affect your statutory rights.
